Summary: | eng: The thesis investigates the question of indigenous rights in Argentina, beginning with the first contacts and legislative decisions taken during the period of colonialism, going on into the independence, nationalism and up to the present. Argentinian indigenous legislative power is reconstructed and estimated by means of socio-historic indicators and international comparison, especially with respect to the latest two events: the law 23.302 (1986) and the reform of the constitution (1994). From the beginnings of colonialism, and up to this century, the Mbya- Guarani - driven by religious resistance - have always been opponents of occidental administration. But around 1980, Misiones (in a new period of democracy) and the Mbya (with an extreme lack of land) had to define their political position with respect to each other. During the next few years, a liberal law was elaborated (including international demands for self-determination or comma law) but was replaced by an old-fashioned law influenced by the Peronist Party and the Catholic Church. Taking these circumstance, into account, and by applying ideas from Action Anthropology, a new provincial law is offered in order to make fiscal and indigenous interests correspond more closely. |
