ger: Die Arbeit versucht, das 1991 neu geschaffene kolumbianische Verfassungsgericht als politische Institution zu analysieren, indem zwei Fragen gestellt werden: Erstens, weist die bisherige Entscheidungstaetigkeit das Gericht als aktivistische Institution aus, d.h. versucht es, seine Kompetenzen auf Kosten anderer politischer Akteure auszudehnen? Zweitens, ist das Gericht eine effektive Institution, werden also seine Urteile befolgt? In der Folge werden vier hypothetische Faktoren, die beim Entstehen von gerichtlichem Aktivismus eine Rolle spielen, formuliert: Kompetenzen der Institution, persoenliche Praeferenzen der Richter, Rechtskultur und Interaktion mit anderen Organen. Anhand konkreter Beispiele wird das Gericht als aktivistisch klassifiziert, wobei sich im Fall Kolumbiens zeigt, dass Praeferenzen, Kompetenzen und Wechselwirkungen mit dem politischen Umfeld diesbezueglich eine grosse, Rechtskultur dagegen eine geringe Rolle spielen. Die daran anschliessende Frage nach der Effizienz dieser aktivistischen Entscheidungen muss zwar je nach Bereich differenziert beantwortet werden, die Durchsetzungsfaehigkeit des Gerichts kann aber im Allgemeinen als gering eingestuft werden. Das Verfassungsgericht wird daher abschliessend als eine Institution klassifiziert, die trotz ihres strategisch kalkulierten Entscheidungsverhaltens immer wieder an der politischen Realitaet anstoesst. Sein gerichtlicher Aktivismus findet daher in der Praxis wenig Beachtung .

eng: This thesis tries to analyze the Constitutional Court, which was created in 1991, as a political institution. Two questions are addressed: First, does its jurisprudence up to now show that the Court can be regarded as an activist institution, i.e. does it attempt to enlarge its own competencies at the expense of other political actors? Second, is the Court an effective institution, in the sense that its judgments are complied with? Four hypothetical factors influencing the emergence of judicial activism are presented next: institutional competencies, personal preferences of the judges, legal culture, and interaction with other organs. Drawing upon concrete examples, the Court is classified as activist. The Colombian case also shows that preferences, competencies and the influence of the political environment play an important role in this regard, whereas legal culture does not. The subsequent question on the effectiveness of these activist decisions has to be answered in a differentiated manner according to the matter under review, but generally the Court's power to secure compliance with its pronouncements has to be classified as low. Summing up, the Constitutional Court is described as an institution, which despite its strategically calculated decision-making behavior often clashes with an adverse political reality. As a consequence, its judicial activism is largely ignored in practice.
