Helmut Koziol’s new book is available. It examines whether personality rights persist after death, if granting defensive remedies to close relatives ascertains appropriate protection, and whether human dignity and life image remain protected assets when no longer associated with a living individual. The work critically assesses § 17a of the Austrian Civil Code, introduced in 2020, concluding that it fails to provide a satisfactory solution and may be incompatible with constitutional rights if not interpreted differently than originally intended.
