Juristenrunde with Andrea Cioni

Andrea Cioni, PhD candidate at the University of Pisa, holds a Juristenrunde lecture titled 'Damages caused by pharmaceutical products: in between the PLD and article 2050 of the Italian Civil Code. Towards a PDL reform' on Tuesday, 21 June 2022, 11.00h.

The pharmaceutical sector is one of the most regulated ones and pharmacovigilance rules have multiplied over the last few years. Still, damages caused by pharmaceutical products pose multiple unresolved legal questions. Andrea Cioni’s presentation addresses some of the most pressing amongst them including: Why, in the face of so many damages, are only few patients able to obtain compensation through PLD? Should we give more importance to the regulations and pharmacovigilance rules when determining the liability? Should product defects of pharmaceuticals be determined by the consumer expectations test or by a risk-benefit assessment? In this latter regard, some recent rulings of the Italian Corte di Casszioni will be presented.

 

The Juristenrunde takes place at the Institute’s premises and is free of charge.
